These Terms of Service ("Terms") govern your use of our services and constitute a legally binding agreement between you and Flairhost ("we," "us," or "our"). By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using our services.

1. Service Description

Flairhost offers game server hosting services ("Services") that allow you to host and manage your own game servers. We provide the necessary infrastructure, tools, and support to ensure a smooth and enjoyable hosting experience.

2. Account Registration

To use our Services, you must create an account by providing accurate and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

3. Payment and Billing

3.1 Our Services are provided on a subscription basis. You agree to pay the applicable fees for the plan you choose, as outlined on our website. All payments are non-refundable, and all purchases are final. We do not provide refunds under any circumstances.

3.2 Your subscription will automatically renew at the end of each billing cycle unless you cancel it prior to the renewal date. You can manage your billing preferences and cancel your subscription through the client area at https://client.flair.host.

3.3 We reserve the right to modify our pricing and plans at any time. Any changes will take effect upon the next billing cycle after the date of the change.

3.4 You are only allowed to order one free trial server. Multiple free trial orders will be terminated. Upon the expiration of the trial period, your server will automatically transition to the 8GB RAM Plan. By continuing to utilize the service beyond the trial period, you agree to be charged in accordance with the 8GB RAM Plan pricing structure, unless you actively upgrade to a paid subscription plan or cancel your service prior to the trial's renewal date. Opting to upgrade will supersede the 8GB RAM Plan with your selected paid plan, and recurring billing will be initiated in accordance with the terms outlined for the chosen paid subscription plan.

3.5 Referrals are on a per-client basis, not on a per-server basis, so each client who has been referred is only valid for one referral reward. To be eligible for affiliate commissions, referred clients who sign up using a free trial must convert to a paid subscription before the trial period ends. Affiliate payouts are only granted for referred clients who become paying customers. Additionally, referred clients must actively use their server during the billing period to qualify for a payout, which is determined at our discretion. Affiliates may be denied payout for this reason. Payouts are processed 2 weeks after the invoice payment date from the referred client.

4. Acceptable Use

4.1 You agree to use our Services in compliance with all applicable laws, regulations, and these Terms. You shall not use our Services for any illegal, abusive, or disruptive activities, including but not limited to:

• Distributing malware or engaging in hacking or unauthorized access to systems.
• Harassing, threatening, or intimidating others.
• Sending spam or unsolicited messages.
• Infringing upon intellectual property rights.
• Engaging in any activity that may disrupt or interfere with our Services.

4.2 We reserve the right to investigate and take appropriate action against any suspected violation of these Terms, including suspending or terminating your account without prior notice and without refund.

4.3 Our Minecraft servers are provided with unmetered storage, with a soft limit of 15GB. This soft limit can be extended by submitting a support ticket. However, please note that soft limit extensions are at our discretion and may be declined for any reason.

5. Intellectual Property

All intellectual property rights related to our Services, including trademarks, logos, and content, are owned by or licensed to Flairhost. You agree not to use, reproduce, or distribute any of our intellectual property without our prior written consent.

6. Privacy and Data Protection

We are committed to protecting your privacy and personal data in accordance with applicable laws and regulations. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your data.

7. Service Modifications, Downtime, and Termination

7.1 We reserve the right to modify, suspend, or discontinue our Services at any time without prior notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.

7.2 Our servers may experience downtime due to various reasons, including but not limited to maintenance, upgrades, or unforeseen circumstances. We will make reasonable efforts to minimize downtime, but we do not guarantee uninterrupted service. No compensation will be provided for any downtime experienced.

7.3 We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. In the event of termination, no refunds will be provided.

8. Disclaimer of Warranties and Liability for Data Loss

8.1 Our Services are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the reliability, availability, or performance of our Services.

8.2 Flairhost shall not be held responsible for any loss of data, including but not limited to game server data, player data, or any other data stored on our servers. It is your responsibility to maintain regular backups of your data to prevent data loss.

9. Limitation of Liability

To the maximum extent permitted by law, Flairhost, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our Services.

10. Indemnification

You agree to indemnify, defend, and hold harmless Flairhost, its directors, employees, partners, and affiliates from and against any claims, liabilities, damages, losses, or expenses arising out of or in connection with your use of our Services or violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States of America. Any dispute arising out of or in connection with these Terms shall be resolved through amicable negotiations or, if unsuccessful, through binding arbitration in accordance with the rules of the American Arbitration Association.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

We reserve the right to modify these Terms at any time. Any changes will be effective upon posting the revised Terms on our website. Your continued use of our Services after the posting of any changes constitutes your acceptance of the revised Terms.
